Welcome to syncnspin.com. These terms and conditions outline the rules and regulations for the use of Sync ‘N’ Spin's website, located at bookings@syncnspin.com. By accessing this website, we assume you accept these terms and conditions. 2. Booking and Payment

2.1 Booking Process

• All bookings are subject to availability and are considered confirmed only when a booking confirmation has been sent via email.

• A deposit of 25% of the total booking fee is required to secure the date and time of the event. 5% of this is the service charge which is non-refundable.

• The remaining balance must be paid in full no later than 7 days before the event date.

2.2 Payment Methods

• Payments can be made via PayPal and bank transfer.

• Invoices will be issued upon receipt of the booking deposit and the final payment.

3. Cancellations and Refunds

3.1 Cancellation by Client

• If the client cancels the booking more than 60 days before the event, the total fee, excluding the non-refundable service charge and the deposit, will be refunded.

• Cancellations made less than 60 days before the event will not be eligible for any refund.

3.2 Cancellation by Sync ‘N’ Spin

• In the unlikely event that we have to cancel the booking, a full refund, including the deposit, will be issued, or we will make every effort to find a suitable replacement act.

4. Event Requirements

4.1 Technical Requirements

• The client must provide a suitable performance area and ensure that the venue meets all technical requirements specified by Sync ‘N’ Spin.

• Access to the venue for setup must be available at least 3 hours before the performance.

4.2 Venue and Equipment

• Sync ‘N’ Spin is not responsible for any venue-related issues, including power outages, acoustics, or any other venue-related problems that may affect the performance.

• Any damage to our equipment caused by the client or the event attendees will be the responsibility of the client and may incur additional charges.

5. Performer Conduct

• Our performers will conduct themselves in a professional manner at all times.

• The client is responsible for ensuring that the performance environment is safe and free from any hazards.

6. Limitation of Liability

• Sync ‘N’ Spin is not liable for any direct, indirect, incidental, or consequential damages that may arise from the performance or any services provided.

• In no event shall our liability exceed the total amount paid by the client for the booking.

7. Privacy and Data Protection

• We respect your privacy and are committed to protecting your personal data. Please refer to our Privacy Policy for details on how we collect, use, and protect your information.

8. Governing Law

• These terms and conditions are governed by and construed in accordance with the laws of United Kingdom, and you irrevocably submit to the exclusive jurisdiction of the courts in that location.

9. Changes to Terms and Conditions

• We reserve the right to amend these terms and conditions at any time. Any changes will be posted on this page, and it is your responsibility to review them regularly.

10. Force Majeure

• Neither party shall be liable for any failure to perform its obligations under this agreement if such failure is caused by events beyond its reasonable control, including but not limited to acts of God, war, terrorism, government regulations, natural disasters, strikes, or other labor disputes.

11. Indemnification

• The client agrees to indemnify, defend, and hold harmless Sync ‘N’ Spin, its employees, agents, and subcontractors from any claims, liabilities, damages, and expenses (including reasonable attorney's fees) arising out of or in connection with the client's breach of these terms and conditions or any wrongful act or omission by the client or its guests.

12. Insurance

• The client is advised to obtain event insurance to cover any potential losses or damages that may arise during the event. Sync ‘N’ Spin carries its own liability insurance but this does not cover damages caused by the client or event attendees.

13. Sound Level and Performance Restrictions

• The client must inform Sync ‘N’ Spin of any sound level restrictions or performance restrictions at the venue at the time of booking. If the performance is stopped or restricted due to venue or local authority regulations, no refund will be given.

14. Client Responsibilities

• The client is responsible for obtaining all necessary permits, licenses, and consents required for the event, including but not limited to noise permits and venue approval.

• The client must provide a safe and suitable environment for the performance, including appropriate access for loading and unloading equipment.

15. Media Release

• The client agrees that Sync ‘N’ Spin may use photographs, video, and audio recordings from the event for promotional purposes, unless the client explicitly requests otherwise in writing prior to the event.

16. Confidentiality

• Both parties agree to keep confidential any sensitive information disclosed during the course of this agreement and not to disclose such information to any third parties without prior written consent, except as required by law.

17. Dispute Resolution

• Any disputes arising out of or in connection with these terms and conditions shall be resolved through good faith negotiations. If the parties cannot resolve the dispute within 60 days, the dispute shall be submitted to mediation or arbitration in England.

18. Entire Agreement

• These terms and conditions, along with any booking confirmation and any additional agreements, constitute the entire agreement between the parties and supersede all prior or contemporaneous understandings, agreements, negotiations, representations, and warranties, both written and oral.

19. Severability

• If any provision of these terms and conditions is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be deemed severed from the remainder of these terms and conditions, which shall remain in full force and effect.
